General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter: “Terms”) govern the sale of consumer goods via the online shop available on https://breathebuddies.com (the “Website”), which operates using a Shopify headless commerce infrastructure.
These Terms regulate the relationship between EKOSOL TT d.o.o. (the “Seller”) and consumers who purchase products via the Website.
By placing an order, the consumer confirms acceptance of these Terms.

(hereinafter referred to as “Seller”, “the Company”, “we”, “our”, or “us”).
Our store is hosted on Shopify Inc., which provides the technical e-commerce infrastructure that enables us to sell products via the Website. Checkout and payment processing services may be provided through Shopify and its partners.
Definitions
- Consumer means a natural person purchasing goods for purposes outside their professional or commercial activity.
- Products / Goods mean physical consumer goods sold via the Website.
- Distance Contract means a contract concluded exclusively via electronic means (online purchase).
1. General Terms and Conditions of Sale
These Terms are prepared in accordance with the Slovenian Consumer Protection Act (ZVPot-1), based on the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS) and international codes for e-commerce.
These Terms govern the operation of the online shop, the rights of users, and the business relationship between the Seller and the Consumer.
The online shop concludes contracts primarily in the Slovenian language. An English version may be available for convenience; in case of discrepancies, the Slovenian version shall prevail.
Orders may be placed only by persons who are legally capable. Minors may place orders only with the consent of their parent or legal guardian.
We reserve the right to amend these Terms by updating this publication. Such changes are binding on users from the date of publication. The offer of goods published on the Website remains valid until revoked or until stocks are sold out.
By placing an order, the user confirms that they are familiar with and accept the Terms of Use, these Terms of Sale, the Privacy Policy, and the Legal Notice.
2. Availability of Information
In accordance with ZVPot-1, the Seller undertakes to make the following information available to the consumer before purchase:
- the identity of the company (company name and registered office, registration number);
- contact details enabling quick and effective communication (e-mail, telephone);
- essential characteristics of the goods (including any after-sales services and warranties, where applicable);
- availability of products (availability and estimated delivery time are shown on the Website and/or during checkout);
- conditions of delivery (method, place and estimated time of delivery);
- clear and unambiguous pricing, including whether prices include VAT and delivery costs;
- payment and delivery methods;
- period of validity of the offer (where applicable);
- the time limit and conditions for withdrawal from the contract;
- whether and how much it costs the consumer to return the product;
- the complaint procedure and customer support contact details.
3. Prices
Prices of products are stated in euros (€) and include value-added tax (VAT), unless explicitly stated otherwise.
Prices are valid at the time of placing the order and may change without prior notice. The prices applicable to the consumer are those displayed during checkout at the time the order is placed and confirmed. Prices cannot be changed afterwards unless both parties expressly agree.
Prices are not adjusted based on automated decision-making (e.g., adapting prices to the consumer’s purchasing power, profile based on previous purchases, etc.).
4. Delivery
Delivery is carried out via Pošta Slovenije and/or other courier services, depending on availability and the delivery option displayed during checkout.
Delivery costs, available delivery methods, and any conditions for free delivery are displayed during checkout before the order is confirmed.
Shipping and packaging costs are borne by the consumer, except in the following cases:
- for individual products where the description includes a note such as “shipping included in the price” or “free delivery”;
- if the consumer’s order exceeds a purchase amount of 30 € including VAT for Slovenia-based delivery or 50 € including VAT for EU Mainland-based delivery (list of countries below);
- when a time-limited promotional campaign “free delivery/shipping” is in progress;
- where the Website/checkout explicitly displays that delivery is free based on the basket total or destination.
- if otherwise agreed in advance between the consumer and the Provider.
Delivery times shown on the Website or during checkout are estimates only and may vary due to carrier operations, public holidays, force majeure events, or other circumstances beyond the Seller’s control.

5. Payment Options
The consumer may pay using payment methods offered at checkout (e.g., card payments, Shopify Payments, PayPal) and/or by bank transfer to the Seller’s bank account, where applicable.
6. Return of Goods / Right of Withdrawal
The consumer has the right to withdraw from a distance contract within 14 days of receiving the goods, without stating a reason.
The consumer must inform the Seller of withdrawal by an unequivocal written statement (e-mail) or via a withdrawal form provided by the Seller.
The consumer must return the goods no later than 14 days from the date of the withdrawal notice. The consumer bears the direct cost of returning the goods.
The Seller will refund all payments (including standard delivery costs) within 14 days of receiving the returned goods or proof of return, using the same payment method unless otherwise agreed, and in a traceable manner. Cash refunds are not possible.
If the consumer has handled the goods more than necessary to establish their nature, characteristics and functioning, the consumer remains entitled to withdraw but is liable for any diminished value of the goods.
Exceptions where the consumer has no right of withdrawal (opened original packaging)
The right of withdrawal does not apply to:
- goods not suitable for return due to health or hygiene reasons if the consumer has opened the packaging after delivery (especially single-use products, personal care products, or goods that come into direct contact with the mouth, nose, skin, or body);
- goods made to the consumer’s precise specifications or clearly personalized;
- digital content if performance began with the consumer’s explicit prior consent and acknowledgement of loss of the right of withdrawal.
7. Exchange of Goods
If the consumer wishes to exchange goods, they may notify the Seller in writing within 14 days of receiving the shipment.
The consumer must return the goods within 14 days of the exchange notice and bears the direct cost of return shipping. Returned goods must be undamaged and accompanied by a copy of the invoice.
The Seller bears the cost of sending replacement goods, unless otherwise stated during checkout or agreed with the consumer.
Exchange is not available for customized goods or goods not suitable for return by their nature, including goods not suitable for return due to health or hygiene reasons if the consumer has opened the packaging after delivery.
If the Seller cannot deliver replacement goods within a reasonable time, the Seller may offer an alternative product, store credit, or refund the purchase price (subject to consumer agreement and applicable law).
8. Issuance of Invoice
By placing an order, the consumer agrees to receive an electronic invoice. The invoice is sent to the consumer’s e-mail address as an attachment to the message confirming dispatch/completion of the order.
The invoice itemizes the price and all costs related to the purchase. The consumer must check the correctness of invoice details.
9. Sales Contract
A distance sales contract is concluded between EKOSOL TT d.o.o. and the consumer through organized distance selling conducted via electronic means (website, internet, e-mail).
By placing an online order, the consumer confirms acceptance of payment and these Terms in full. An order is generally considered concluded when the consumer receives an order confirmation by e-mail, unless otherwise specified.

10. Return of Damaged Shipments
If a package is physically damaged, incomplete, or shows signs of opening, the consumer should notify the courier immediately upon delivery and document the damage (photos).
The consumer should send the photos and a description of the issue to the Seller. Replacement or refund will be arranged by the Seller in accordance with applicable law.
11. Communication
The Seller may contact the user via distance communication means unless the user expressly objects.
Promotional electronic messages will be clearly marked as advertising, will identify the sender, will specify promotion conditions, and will include a clear method for unsubscribing. The Seller will respect opt-out requests.
12. Warranty / Conformity of Goods
Any commercial warranty (if offered) applies under the conditions stated in the warranty certificate and applicable advertising.
This does not affect the Seller’s statutory liability for conformity of goods under ZVPot-1.
13. Protection of Personal Data
Personal data is processed in accordance with GDPR and applicable Slovenian law, as described in the Privacy Policy.
14. Complaints and Disputes
The Seller strives to maintain an effective complaint-handling system. The Seller will confirm receipt of a complaint within five working days and inform the consumer of the expected handling time.
The Seller seeks to resolve disputes amicably. If this is not possible, disputes fall under the jurisdiction of the competent court in Nova Gorica, Slovenia.
The consumer is informed of the possibility of alternative dispute resolution in accordance with Slovenian law.
15. Disclaimer of Liability
The Seller strives for accurate information but does not guarantee that all data are free from technical or clerical errors.
In case of an obvious error, the Seller reserves the right to withdraw from the contract. Obvious errors include material mistakes in product characteristics or pricing that would not have been accepted under normal commercial practice.
The Seller is not responsible for occasional website outages or minor visual differences in product images due to different screen resolutions.
16. Non-Conformity of Goods
The Seller must fulfill contractual obligations without delay, and no later than 30 days after conclusion of the contract unless otherwise agreed.
The Seller is liable for any non-conformity existing at delivery that becomes apparent within two years of delivery.
In case of non-conformity, the consumer may request free repair or replacement. If conformity is not restored within 30 days (extendable by up to 15 days where justified), the consumer may request a proportional price reduction or withdraw from the contract and demand a refund.
If the Seller fails to properly inform the consumer about the right of withdrawal before the contract becomes binding, the withdrawal period may be extended as provided by law.
17. Legal Notice & User Content
All content is owned and operated by the Seller and may be used only for non-commercial purposes unless otherwise permitted by law or by written consent.
User images, opinions, comments and product reviews may be reviewed before publication. Offensive or inappropriate content will not be published.
By submitting content, the user grants the Seller a non-exclusive right to use it for business and marketing purposes, and the user guarantees that they own all necessary rights to the submitted material.
